Terms of Use

Welcome to Cal Pal. These Terms of Use are the agreement between you and Jill Priya Keshyap ("we", "us", "Cal Pal") for your use of the Cal Pal mobile app and the trycalpal.com website (together, the "Service"). By downloading, or using the Service, you agree to these terms. If you do not agree, please do not use the Service.

1. Who can use Cal Pal

You must be at least 16 years old to use the Service. By using it, you confirm that you meet this requirement and that the information you give us is accurate.

2. Your licence to use the app

We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use Cal Pal on any Apple device that you own or control, in line with the Apple Media Services Terms and Conditions and these terms. You may not copy, resell, reverse engineer, or attempt to extract the source code of the app, except where the law allows it.

3. Subscriptions, billing, and free trials

Cal Pal offers auto-renewable subscriptions that unlock premium features. Plans (for example annual, quarterly, and monthly) and their prices are shown in the app at the point of purchase, in your local currency. Some plans include a free trial.

• Payment is charged to your Apple ID account at confirmation of purchase.
• Auto-renewal: your subscription renews automatically at the end of each period unless you turn off auto-renew at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the period ends, at the price for the plan you selected.
• Free trial: if your plan includes a free trial and you do not cancel before it ends, the subscription converts to a paid plan and you are charged the price shown. Any unused portion of a free trial is forfeited when you buy a subscription.
• Managing or cancelling: you can manage or cancel your subscription in your device Settings under your Apple ID, in the Subscriptions section, at any time. Cancelling stops the next renewal but does not refund the current period.
• Refunds are handled by Apple under the Apple Media Services Terms and Conditions. We do not process payments or issue refunds directly.

4. Health and nutrition disclaimer

Cal Pal helps you find recipes and track calories and macros for general wellness. It is not medical advice, and it is not a substitute for a doctor, dietitian, or other qualified health professional. Nutrition estimates, recipe suggestions, and calorie targets are approximate. Always check ingredients for allergens yourself, and speak with a professional before making significant changes to your diet, especially if you have a medical condition, a food allergy, or are pregnant. You use the Service and rely on its content at your own discretion.

5. Acceptable use

You agree not to misuse the Service. In particular you will not use it for any unlawful purpose, upload harmful or infringing content, interfere with its normal operation, or try to access it in ways we did not intend.

6. Your content

The Service may let you add content such as photos of ingredients, saved meals, and goals. You keep ownership of your content. You give us a limited licence to store and process it so we can provide the Service to you, for example to generate recipe matches from a photo. You are responsible for the content you provide.

7. Our content

Cal Pal, its name, logo, design, recipes, and software are owned by us or our licensors and are protected by intellectual property law. These terms do not give you any right to use our branding without our written permission.

8. Ending your access

You can stop using the Service at any time and delete the app. We may suspend or end your access if you break these terms or use the Service in a way that could harm us or other users.

9. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent allowed by law, we do not make promises that it will be uninterrupted, error free, or that any result or nutrition estimate will be accurate for your circumstances.

10. Limitation of liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, or consequential losses arising from your use of the Service. Nothing in these terms limits any liability that cannot be limited by law.

11. Apple as a third party beneficiary

This agreement is between you and us, not with Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for the app. Apple and its subsidiaries are third party beneficiaries of these terms and may enforce them against you. For subscriptions bought through the App Store, the Apple Media Services Terms and Conditions also apply.

12. Changes to these terms

We may update these terms from time to time. If we make a material change, we will update the date at the top of this page and, where appropriate, let you know in the app. Continuing to use the Service after a change means you accept the updated terms.
